Welcome to Safesoul Limited, trading as ‘Safesoul.’ Before engaging with our goods and services, please carefully read and understand the terms and conditions outlined below. By purchasing any Services from us, you agree to be bound by these terms and conditions.

Customer Confirmation

By purchasing Services, you confirm that:

You are at least 18 years old.

You are legally capable of entering binding contracts.

You access our website from within the UK for equipment rental or monitoring services. For equipment not involving rental or monitoring services, access is from anywhere worldwide, excluding the United States of America and Canada.

If purchasing on behalf of someone else, you remain responsible for compliance with these terms and conditions.

Agreement Basis

By purchasing Services, you agree that:

Your acceptance of our terms and conditions constitutes a binding contract.

Terms and conditions, along with your order acknowledgment email/letter, constitute the entire agreement.

Any inconsistency between the order acknowledgment email/letter and terms and conditions, the former prevails.

Quotations are valid for 30 days, and we may revise terms and conditions with notice.

Our Obligations to You

We will:

Dispatch equipment within 1 working day (where installation is not chosen).

Arrange equipment installation within 7 working days (if purchased).

Provide Services with skill and care, meeting statutory requirements.

Notify you of any changes necessary to comply with law or safety.

Respond fairly to complaints.

Customer Obligations (Safesoul care)

Before monitoring service activation:

Complete required forms.

Obtain permissions from key holders.

Give access to property and medical records.

Notify of any changes promptly.

Test equipment regularly.

Post-installation:

Co-operate with us in all matters relating to Services.

Pricing and Payment

Prices exclude VAT, and you must indicate VAT exemption eligibility.

Set-up fees are one-off payments.

Monthly/annual fees are payable via direct debit.

We may revise monthly fees with notice.

Late payments may incur additional interest.

We reserve the right to cancel Services for non-payment.

Late payments may be subject to an additional interest charge of 4% per year. This interest shall accrue on a daily basis from the due date until the date of actual payment. You must pay us interest together with any overdue amount.

 

Use of Rented Equipment

Equipment remains our property.

Prompt return of equipment on termination.

Failure to return incurs a fee of £189.99 (plus VAT if applicable).

Upon receipt of the returned Equipment, we will inspect the equipment for damage (other than fair wear and tear) and we reserve the right to charge reasonable additional sums for any such damage that has occurred.

Use of 24/7 Monitoring Service

Monthly fee includes call, text, and data charges.

Excessive use may result in service cancellation.

Damage to Property

Not responsible for damage caused by emergency services due to lack of access.

Automatic Fall Detection

Equipment may not detect all falls.

Manual activation is recommended.

Safesoul Care(24/7 Monitoring)

Leased equipment must be returned on service cancellation.

Failure to return incurs £189.99 (plus VAT if applicable).

Note:

If your purchase is from the Safesoul Care (24/7 Monitoring)  then you will receive an e-mail from us acknowledging that we have received your order. This does not mean that your order has been accepted. Your order constitutes an offer to us to rent equipment and/or to purchase monitoring services. We will then request the necessary additional information required for us to provide the Services, and for you to pay for the Services. Once you have provided this information the Contract shall come into existence between us and you.

If you are purchasing equipment from us from any other product category then the order acknowledgement email is a confirmation of your order for the equipment only and the point at which a contract between us comes into existence.

Safesoul Devices

Reliability of mobile phone and GPS signals is not guaranteed.

User responsible for sufficient SIM card credit.

Installation & Demonstration

 

If you have selected to have your alarm or key safe equipment installed by us (selected equipment only) then we will arrange for one of our sub- contractors to install and demonstrate it at a mutually agreed time.

Installation not guaranteed.

Cancellation policy applies.

Annual Plan cancelation

Refunds based on unused months.

Conditions apply, including non-refundable set-up fees.

When an annual plan is canceled early by you, we will refund you for unused months. This is only after all equipment is returned to us, and on the following basis:

  1. Annual plan refunds will be based on the total amount paid at the beginning of the year minus:
  2. Number of full or partial months service used multiplied by our standard monthly rate of £20.99.
  3. £15 non-refundable set-up fee.
  4. iii. £10 administration fee.
  5. Special Offers

Where you have purchased a product marked ‘Special Offer’ in the product name, this clause supersedes any other clause within the terms and conditions. Products marked ‘Special Offer’ have the following terms and conditions:

The special offer is a time restricted offer. The special offer period is 12 months from the date of purchase.

When the special offer period has expired, the pricing with revert to the original pricing.

Special Offer products are available for new customers only.

 

Special Offers

Time-restricted offers with specific terms.

Annual plan refunds based on conditions.

Cancelation

Cancelation within 14 days allowed.

Equipment return cost is customer’s responsibility.

Warranty for Services

Outright purchased equipment covered by 12-month warranty.

Rented equipment covered for the duration of the agreement.

No warranty for damage due to negligence or misuse.

Limitation of Liability

Limited liability for foreseeable losses.

Not liable for losses related to your failure to comply with the agreement.

No liability for pricing errors or delays due to your actions.

Events Outside Our Control

Not liable for delayed or failed performance due to Force Majeure Events.

Intellectual Property

Retain rights to all intellectual property provided.

No commercial use permitted.

Assignment

Transfer of rights or obligations requires our written consent.

Data Protection

Personal information use governed by our Privacy Policy.

Supervisory Authority

Financial Conduct Authority is the supervisory authority for consumer credit.

General Conditions

Governing law: English law; Jurisdiction: English courts.

Agreement deemed invalid where not permitted by law.

Failure to exercise rights does not constitute a waiver.
